Promotion Proof
Service terms
Last updated 26 August 2026. These terms apply to the one-off Promotion Proof campaign-check service.
1. Provider and business customer
Promotion Proof is operated from Ireland by Mark Barron trading as Emma Enterprises Group. Contact: mark@emmaenterprisesgroup.com. The service is offered only for business use to Shopify merchants, ecommerce teams and agencies. By ordering, you confirm that you are acting for purposes connected with a trade, business, craft or profession and have authority to bind that business.
If you are legally entitled to mandatory consumer protections despite that statement, nothing in these terms excludes or restricts those rights.
2. The service
The direct $29 USD fee covers one agreed Shopify storefront, one supported percentage or fixed-amount discount-code promotion, nominated products, and one agreed market and currency. We review the advertised claim, selected product, cart and standard guest-checkout journey using the public or customer-accessible storefront.
The check stops before payment. We do not place an order, request Shopify administrator access, install an app, change store settings or run recurring monitoring. Subscription promotions, automatic discounts, multiple markets, multiple stores or other work are included only if expressly agreed in writing.
3. Ordering and contract formation
Before payment, the intake form lets you review and correct the campaign details you submit. It identifies whether the request appears to fit the advertised scope and then directs supported requests to Stripe. A service contract is formed when the $29 USD payment is successfully received and the submitted request is accepted as supported. An automated receipt or submission acknowledgement does not by itself confirm that unsupported work has been accepted.
Use the same work email for the intake and Stripe checkout so the records can be matched. The contract is in English. These terms can be saved or printed from this page.
4. Information and authority you provide
You confirm that the submitted details are accurate, that you own or manage the storefront or are authorised by the responsible business, and that the requested activity is lawful. Do not submit passwords, administrator credentials, customer personal data, real payment information or material that you are not permitted to share.
Delivery may pause while missing, inconsistent or ambiguous information is clarified. The delivery target then runs from receipt of the complete supported information and matched payment.
5. Result and delivery
We aim to send the evidence report to the matched work email within one business day. The report records observations within the agreed scope and returns PASS, FAIL or NEEDS REVIEW. PASS means the observed claim and checkout result matched for that check; it is not a guarantee that the promotion will remain unchanged or work for every customer or configuration. NEEDS REVIEW is used where evidence is blocked, incomplete, ambiguous or unsupported.
6. Price, tax and marketplace orders
The direct service price is $29 USD for one check. Stripe displays the amount due before payment. Fiverr and Upwork offers may be priced separately and are ordered, paid for, delivered and discussed entirely within that marketplace. Marketplace terms and dispute procedures also apply to those orders. No off-platform payment or communication is required.
7. Refunds and corrections
If we cannot deliver a supported result within the agreed scope, the service fee will be refunded to the original payment route. A disagreement with an accurately reported observation does not automatically create a refund right, but demonstrable evidence or calculation errors will be corrected. Any mandatory statutory refund or cancellation right continues to apply.
8. Your use of the report
You may use and share the report internally and with the client responsible for the checked campaign. Promotion Proof retains ownership of its method, format and reusable materials. Neither party may use the other's name, logo or report as a public endorsement without written permission.
9. Confidentiality and data
Non-public campaign information will be used only to review, perform and support the service, subject to legal obligations and the Privacy notice. The check is designed to use public storefront evidence and does not require customer information or store credentials.
10. Important limitations
The report is a time-specific operational check, not legal, tax, accounting, security, accessibility or financial advice or certification. You remain responsible for campaign configuration, stock, pricing, customer communications and the final launch decision.
To the extent permitted by law, neither party is liable for indirect or consequential loss, lost profits, lost advertising spend or loss caused by information or storefront conditions outside that party's reasonable control. Promotion Proof's aggregate liability arising from a check will not exceed the fee paid for that check. Nothing excludes liability that cannot lawfully be excluded, including for fraud, fraudulent misrepresentation, wilful misconduct, or death or personal injury caused by negligence.
11. Availability, changes and termination
We may refuse or cancel a request that is unsafe, unlawful, unauthorised, outside scope or cannot be completed without credentials or a real order. If a paid request is cancelled for those reasons before a supported result is delivered, the fee will be refunded unless law permits otherwise because of misuse or fraud. Terms applying to an existing order will not be changed retrospectively without agreement.
12. Irish law and disputes
These terms and non-contractual disputes are governed by Irish law. The courts of Ireland have jurisdiction, except where mandatory law gives a protected customer the right to bring a claim elsewhere. Please contact mark@emmaenterprisesgroup.com first so a concern can be reviewed promptly.
